Terms
Terms of Service
These Terms of Service ("Terms") are an agreement between you and Guestality LLC ("Guestality," "we," "us"). They cover your use of guestality.co, guest pages, NFC bracelets, rings and cards, QR codes, and our private texting service (together, the "Service"). By using the Service, you agree to these Terms. Our Privacy Policy explains how we collect, use and share personal information. Some things it describes need a separate choice, such as a guest agreeing to receive texts; accepting these Terms never replaces that choice.
1. Accounts
Professional accounts are for individuals 18 or older. You agree to give accurate information, keep your password private, and tell us right away at info@guestality.co if you think your account has been used without permission. You are responsible for activity on your account.
2. Your Guest Book and content
Your rights. You keep whatever rights you have in the information you lawfully add to your profile and Guest Book ("Your Content"). Guestality does not claim ownership of it. Information about guests is also about the guests themselves, so your use of it is subject to their privacy choices, any texting permission they gave or withdrew, the law, and any obligations you have to your employer or venue.
Our limited license. You give Guestality a non-exclusive permission to host, store, copy, display, transmit and process Your Content only as needed to provide, secure and support the Service for you, to meet legal obligations, and as described in the Privacy Policy. The service providers that help us run the Service (Privacy Policy, section 3) may process it for us, limited to those purposes. We don't sell Your Content or license it to anyone for their own use. The details you put on your public guest page are shown to anyone who opens it, because that is what the page is for. This permission ends when Your Content is deleted from the Service, except for records we keep as described in the Privacy Policy.
Your responsibilities. You confirm that you have the right to collect and use Your Content. Collect guest information only from guests who chose to share it with you, use it only to serve and stay in touch with those guests, and update or delete a guest's details when they ask, unless the law requires you to keep them. Do not store payment card numbers, government ID numbers, passwords, medical histories, diagnoses or guesses about anyone's health in the Guest Book.
Dining needs. Guests may tell you about allergies or dietary needs so you can serve them. Treat these details as sensitive: record only what the guest told you and use them only to serve that guest. A Guest Book note can be incomplete or out of date and is not a safety system, so always confirm allergies and dietary needs directly with the guest and the venue before each visit or order. Guestality is not a health-care service.
Your relationship with your employer or venue is your own. You are responsible for following any workplace policies that apply to keeping guest contacts.
3. Acceptable use
You may not use the Service to: send spam or unsolicited messages; text anyone who hasn't agreed to texts or who has opted out; harass, threaten or deceive anyone; impersonate another person or business; post unlawful, hateful or sexually explicit content; collect information about people who haven't agreed to share it; interfere with or try to break the Service's security; or resell the Service without our written permission.
4. Plans, billing and cancellation
Prices. The Service is offered on a monthly or yearly subscription. Current prices are on our Pricing page. Before you pay, checkout shows the amount due today and the amount and start date of each future charge. Some packages include a one-time amount on the first day (for example, for hardware in the package); hardware is not charged again at renewal. Applicable taxes are added at checkout. A discount code applies only as described when you enter it. Payments are processed by Stripe.
Renewal. Subscriptions renew automatically at the end of each billing period, at the renewal amount shown at checkout, until you cancel. We may change prices with at least 30 days' notice. A price change takes effect at your next renewal after the notice.
Cancelling your plan. You can cancel anytime from Settings (Cancel Subscription or Manage Billing). Cancellation takes effect at the end of your current billing period, and you keep access until then. After paid access ends, your guest page, QR code and devices stop opening your page, your Guest Book becomes read-only, and you can still download your data for 30 days. Cancelling a plan does not delete your account or your data; see section 9 for deletion.
Failed payments. If a renewal payment fails, everything keeps working for 7 days while the card is retried. After that, your guest page is paused and your Guest Book becomes read-only until the payment is resolved.
Private Number add-on. The Private Number add-on needs an active plan. It can be billed together with your plan, on the plan's schedule, or on its own. Ending your plan ends the Private Number too. A Private Number billed with your plan can be ended on its own from Settings; it ends right away and the unused time is credited on your next bill. Its setup fee is a one-time charge.
Refunds. Except where the law requires otherwise, payments are non-refundable and we do not give refunds or credits for partial periods. We may issue a refund or credit at our discretion. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.
5. NFC devices
Every plan includes one Guestality Tap card at no extra charge, shipped when cards are available. Bracelets, rings and additional cards are sold as one-time purchases when they are offered. A device shown as coming soon, or offered while ordering is closed, can't be ordered. When a device that is on sale (including the Tap card included with your plan) is temporarily out of stock, we may accept your order as a backorder: checkout shows that status before you pay, and it ships when stock arrives. We show an expected ship date only when we have one, and ship dates are estimates. This doesn't limit any rights the law gives you when an order is delayed. Devices are shipped to the address you give us.
A device opens your Guestality page while your plan is active and the device is linked to your account. It stops opening your page if your plan ends or is paused, if you report it lost or stolen, or if the device or account is disabled under section 9. Phones vary, and some phones can't read NFC; the QR code included with your plan works as a backup.
If a device arrives damaged or doesn't work, contact us within 30 days of delivery and we'll replace it. If a device is lost or stolen, tell us and we'll turn it off. Devices are not returnable for a refund once they have been linked to your account, except where the law requires otherwise. This section does not limit any warranty or consumer right that the law gives you and that cannot be excluded.
6. Text-messaging terms
Program. Guestality Private Texting lets hospitality professionals who have a Private Number text with guests from their own Guestality number. Sending turns on only after US carriers approve Guestality's business texting registration.
How a guest agrees to texts. A professional may text a guest only in one of these two cases:
- Join form. When asking to join the professional's Guest Book, the guest ticks the separate, optional, unticked "Yes, [professional's first name] may text me" box. We record the exact wording shown and the time. The tick counts only after the guest proves the number is theirs with a one-time verification text and the professional accepts the request, and only while no opt-out is on record. Joining without ticking the box does not opt a guest in to texts.
- The guest texts first. If a guest texts the professional's Guestality number, the professional may reply and continue that conversation about what the guest raised. This does not permit adding the guest to recurring or unrelated messages.
Agreeing to texts is never a condition of any purchase.
Verification text. A verification text contains a one-time code or link and is sent only to confirm that the number belongs to the guest who ticked the box. It is not a visit confirmation or a promotion, and verifying never adds any permission beyond the ticked box.
Messages. Texts are personal conversations: replies, and visit and reservation details. Message frequency varies. Message and data rates may apply.
Opting out. Reply STOP to any message to stop receiving texts from that number. A final message confirming the opt-out may be sent, but it isn't guaranteed. STOP stops texts; it does not delete a guest's details from the professional's Guest Book (to remove them, ask the professional or contact us). Reply START to receive texts again; START works only when the guest's own STOP is what stopped the texts, and it never lifts an opt-out that the professional recorded for the guest. Reply HELP for help, visit our Help page, or email info@guestality.co.
Carriers. Mobile carriers are not liable for delayed or undelivered messages.
Professionals' responsibilities. Professionals may text only guests who agreed as described above, must not send marketing or unrelated messages, and must honor every opt-out. Guestality blocks texts to anyone who has replied STOP and to anyone the professional has recorded as asking not to be texted.
Monthly allowance. The Private Number includes 200 message segments per calendar month, and texts sent and received both count. A text of up to 160 standard characters is one segment; longer texts are split into segments of up to 153 characters. A text with emoji or certain special characters uses a different format: up to 70 characters for one segment, or segments of up to 67 characters when longer. The count starts over on the 1st of each month at midnight UTC. When the allowance is used up, sending new texts is blocked until it starts over; texts from guests still arrive and are shown. There is no automatic charge for going over. Additional texts, if offered, are priced and agreed separately before any charge. Usage is shown in the app.
Privacy. Phone numbers and opt-in consent are never sold or shared for marketing. See our Privacy Policy.
7. Guests
If you visit a guest page as a guest, you can use it for free. When you join a Guest Book, you send a request to that professional; if they accept it, your details are added to their Guest Book. Guestality and its service providers also handle your details to run the Service, as described in the Privacy Policy. Each professional is responsible for how they use your details. You can ask them to remove your details, reply STOP to stop texts, or contact us.
8. Guestality's property
The Service, including its software, design, logo and the Guestality name, belongs to Guestality LLC. We give you a limited, personal, non-transferable right to use the Service under these Terms. Don't copy, modify or reverse-engineer it.
9. Deleting your account, suspension and termination
Deleting your account. You can ask to delete your account at any time in Settings. Deleting is different from cancelling: it cancels your plan and any Private Number immediately, rather than at the end of the billing period, and remaining time is not refunded except where the law requires it or we choose to. We then delete your account data as described in the Privacy Policy. If your account has device orders, we keep the order, payment and tax records we need and delete your other account data; for these accounts, our team may complete the deletion after you send the request from Settings.
Suspension. We may suspend or close an account, turn off a guest page, or disable devices if you break these Terms, don't pay, or create risk or legal exposure for Guestality or others. Where reasonable, we'll tell you first and give you a chance to fix the problem.
10. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Service will always be available, error-free, or that any text, email or device tap will always be delivered or work on every phone.
11. Limitation of liability
To the fullest extent allowed by law, Guestality will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or $100. Some places don't allow these limits, so they may not apply to you.
12. Indemnity
You agree to defend and hold Guestality harmless from claims arising from Your Content, your messages to guests, or your violation of these Terms or the law.
13. Governing law and disputes
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules. Before filing a claim, you agree to contact us at info@guestality.co and try to resolve it informally for 30 days. Any dispute that isn't resolved will be handled in the state or federal courts located in Maricopa County, Arizona, and you and Guestality consent to their jurisdiction. Either party may bring a qualifying claim in small-claims court.
14. Changes to these Terms
We may update these Terms from time to time. We'll post the new version here with a new effective date and, for significant changes, notify professionals by email or in the app. Continuing to use the Service after a change means you accept the updated Terms.
15. General
These Terms are the entire agreement between you and Guestality about the Service; the Privacy Policy explains how we handle information. If any part is found unenforceable, the rest stays in effect. Our not enforcing a term is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets.
